RENTAL POLICY


 

Administration Fee

 
An administration fee of eighty-five (85) dollars will be added to each reservation for administrative and processing of your reservation. The administration fee is non-refundable.

 

Accidental Damage Waiver

 
Included within your rental fee is coverage for accidental damage that may take place at the property during your stay. The waiver only applies to accidental damages that are reported prior to check-out. Damages or losses excluded from or otherwise not covered by the waiver clause will be charged to the guest. The full terms of the Accidental Damage Waiver plan are listed in the Accidental Damage Waiver Addendum section, and fully incorporated herein as an express term of this Agreement.

 

Age Requirements

 
Your Beachfront Getaway’s (hereafter called YBG) vacation accommodation is a family rental. This unit will not be rented to vacationing students or young adults under the age of 25. However, we understand extenuating circumstances may apply, please contact YBG for specific information. A parent or guardian must accompany their children under the age of twenty-five at all times. In accordance with Florida State Statute 509.141, reservations made under false pretense are null and void. This policy includes reservations made by parents or guardians who do not check in, and/or who leave overnight during the length of the stay, and/or stay in a different unit. Guests who violate this policy are subject to immediate eviction and forfeiture of all rental payments.

 

Applicable Law

 
This Agreement shall be governed by, construed under, and enforced and interpreted in accordance with the laws of the State of Florida, excluding its principles of conflicts of laws.

 

Balcony

 
Throwing anything off balconies is a FELONY OFFENSE. Violators will be prosecuted to the fullest extent of the Law and will be subject to immediate eviction. State Law prohibits feeding of birds from balconies. Per Local, State, and National Fire Codes, gas or charcoal grills are not allowed on the balcony or in the building. No sweeping of water or debris from the balcony is allowed. The hanging of bathing suits, clothing, towels, rugs, or other items from or upon the railings or windows is prohibited.

 

Beach and Pool Towels

 
Please bring beach and/or pool towels, as we do not permit bath towels or linens to be taken from the unit.



Beach Rules

 
Please make every effort to keep our beaches beautiful. Remove all umbrellas, chairs, and toys from the beach each day. Items left on the beach one hour after sunset or placed on the beach one hour from sunrise will be removed by Code Enforcement and may not be recoverable. Shade canopies and tents are not allowed on the beach side of the line of chaises set up by Beach Services. High winds are common on the beach and have sent structures rolling down the beach, causing injuries to beachgoers. Please erect tents or canopies along the fence next to the sea oats berm. Please consult the beach attendant or signage for additional regulations. Observe the warning flags posted at every public access for your safety. Bonfires on the Beach House property including the beach area are prohibited.



Beach Service

 
Beach service availability is seasonal and weather permitting. Complimentary beach service is a seasonal service between March and October. Complimentary beach service, which includes two chairs and one umbrella, is only offered during normal business hours until 5PM.


 

Cancellations and Changes

 
You may cancel sixty (60) days prior to your arrival date and receive a full refund, less the eighty-five (85) dollar administration fee. YBG does not issue any refunds for cancellations made less than sixty (60) days from the arrival date. If you should have to cancel your reservation, please notify us immediately. Any refunds for cancellations made after the Cancellation Period has expired must be obtained from CSA Travel Protection and are subject to their policies, conditions and restrictions. For questions concerning the travel insurance or to make a claim due to a cancellation, please call CSA directly at 800-554-9839. No refunds will be made in the event of a mandatory evacuation if guest does not purchase CSA insurance.



Check-In/Check-Out Times

 
Check-in begins at 4:00 PM (CST) on scheduled day of arrival. Check-out is 10:00 AM (CST) on scheduled day of departure.



Construction

 
There may be construction ongoing at properties adjacent to or close by the property being rented by guests. The rules regarding acceptable noise levels, start and finishing times, and other restrictions relating to any such construction are governed by local ordinances and/or community specific rules and regulations beyond the control of YBG. As such, guests shall not be entitled to a refund relating to such construction. Notwithstanding this, YBG will use its best efforts to ensure that the appropriate parties are notified, and appropriate remedial action taken in the event that it receives notice that the construction at issue may be in violation of any such regulations or ordinances.



Damage Policy

 
Guests are responsible for the property, its contents, and themselves during occupancy. Guests must lock windows and doors securely when not in the premises. Rearranging the furniture or removing any items from the unit is prohibited. After Check-out, YBG will inspect the unit for damage, missing items, and abnormally dirty appearance. If YBG determines that damage is present, items are missing, or the unit is abnormally dirty, YBG will repair the damage, replace the missing items, and/or perform a deep clean of the unit at renter’s expense. YBG will charge guests in in accordance with the Accidental Damage Waiver Addendum to receive reimbursement for any such expense.


 

Deposit

 
A reservation deposit is due at the time of the reservation. This deposit will be applied towards the total booking charges due. This is not a damage deposit. The reservation deposit is 50% of the total amount due.



Emergency Information

 
For any emergency, dial 911. The onsite security number is 850-259-3273. During peak times of the season, security will be on site at night. The Association Office number is 850-650-2130 and is open 9:00- 5:00 five days a week.



Indemnification

 
By placing a reservation payment, Guest understands and agrees to the following:

Guest agrees to defend, indemnify and hold Homeowner harmless from any and all liability, claims, loss, property damage, or expenses, arising by reason of any injury, death, or damage sustained by any person, or to the property of any person, in or on the Property during the Term of this Agreement, including Guest all invitees or visitors of the Guests where such injury, death or damage is caused by a negligent or intentional act of Guest, additional guest, or any of guest’s visitors or invitees.



Housekeeping

 
Your vacation accommodations will be cleaned to our quality standards prior to your arrival and after your departure. You will be responsible for the cleaning of your unit during your stay and for leaving the unit in good condition at check-out. We respectfully request that you remember that you are staying in our home during your vacation; please treat it with the care as you would your own. If the unit is found abnormally dirty at check-out, additional charges will be charged to guest to assist in performing a deep clean of the unit. The unit should have initial supplies of trash liners, toilet paper, paper towels, bath and hand soaps, dishwashing detergent and laundry detergent and towels. Please let us know upon arrival if any of these are missing. All stays will be subject to a cleaning fee. Additional cleanings can be arranged during your stay for an additional fee if you prefer.

 

Additional waste removal instructions are below:

  • Guests are not to dispose of refuse on or from balconies, halls, stairways, or walkways.
  • Guests are responsible for their own trash removal. Garbage is to be sealed in plastic garbage bags and disposed in the garbage chute on each floor. Garbage dumpsters are for food and drink refuse only.



Hurricanes and Severe Weather

 
Guests covered by CSA Travel Protection may be entitled to a refund or partial refund in the event that the National Hurricane Center and our local governing officials issue a “Mandatory Evacuation” order for the location of your rental property, provided that you have purchased coverage before the storm was named. Any such refunds shall be subject to the terms, conditions, and restrictions of the CSA Travel Protection Policy. Details about the coverage can be obtained by reviewing the certificate of insurance on their website www.vacationrentalinsurance.com/330CERT or by calling CSA at 866-999-4018.

Refunds for cancellations or shortened days due to actual or anticipated hurricanes, tropical storms or other inclement weather will not be issued by YBG under any circumstances.


 

Luggage Carts

 
Luggage carts are for the use of our guests. Luggage carts are NOT permitted inside the condo units. Please return the luggage carts immediately after use to the storage area next to the elevators of each building.


 

Maintenance

 
During your stay, promptly report any maintenance problems to YBG. No refund or rate adjustment will be made for unforeseen failures such as the supply of electricity, water, pool filtration systems, air conditioning, television or cable services, internet, appliances, etc.



Maximum Occupancy

 
The maximum number of guests per accommodation is eight people. This number is based on the individual accommodation’s ability to comfortably and safely house our guests. If the maximum occupancy is exceeded, you may be asked to vacate the property and forfeit any rental payments.



Method of Payment

 
The method of payment is by credit card (MasterCard, Visa, American Express, or Discover Card). Accepted forms of payment are in U.S. funds only. The balance of the total booking charges is due forty-five (45) days prior to arrival. For reservations made less than forty-five (45) days prior to arrival, immediate payment in full is required.



Minimum stay requirements

 
The minimum stay requirement is three (3) nights. Longer stays are required during peak seasons and holidays. One-week minimum stays apply during peak and holiday periods, with Saturday arrival and Saturday departure.

No Pets: Pets are NOT permitted. Guests who violate this policy will be charged an additional $500, plus the expense of any necessary cleaning. Violations may also result in immediate eviction and forfeiture of rent.

No Smoking: Smoking is NOT permitted either inside the unit or on the balcony. Guests who violate this policy will be charged an additional $500, plus the expense of necessary cleaning. Violations may result in immediate eviction and forfeiture of rent.


 

No subletting

 
The rental property may not be sublet. Your reservation is not transferable to any other party.



Noise Ordinance

 
Florida Statute 125.01 prohibits excessive noise at any time. Guests are to regulate their behavior in their units to avoid disturbing other residents. No nuisances are to be allowed, nor any practice followed, that is the source for annoyance to other residents. Sound from any unit or balcony, as from radios, musical instruments, stereos, television and conversation, is to be such that an annoyance is not created. QUIET TIME IS 10PM TO 8AM. Igniting fireworks anywhere on Beach House property including the beach and beach access is prohibited. Continued noncompliance with HOA noise rules and regulations may result in eviction.



Parking

 
All vehicles parked in the surface lots must have a valid Guest Parking Pass clearly displayed on the dash board. Any vehicle not displaying a valid pass or decal is subject to being TOWED without notice. Trailers, RVs, boats are NOT allowed in parking areas and must be parked offsite.



Pool Rules

 

Condominium pools are not controlled or maintained by YBG, therefore, YBG cannot be held responsible for inconveniences resulting from the pool. Community Pool Heating is offered seasonally under the control of the HOA.

 

  • Swimming pools and all related gazebos are for use by Beach House Owners and Guests only between the hours of 9 am and 10 pm. Guests using the facilities must be registered, over-night guests (staying at Beach House) or accompanied by an Owner. Guests may not invite guests to use the
  • Anyone in violation of the pool rules may be asked to leave the pool
  • Children under the age of 12 years MUST BE AT ALL TIMES accompanied by an Adult who is responsible for them. PARENTS: Please don’t leave children at one pool while you are at another, or on the THERE ARE NO LIFEGUARDS ON SITE. IT IS YOUR RESPONSIBILITY TO SUPERVISE YOUR CHILDREN.
  • The placement of towels or clothing on chairs, tables, or lounges DOES NOT RESERVE
  • Radios, CD players, etc. are prohibited except as used with
  • Infant floats are the only flotation devices allowed in the
  • Children who are not toilet trained must wear swim diapers in the
  • Owners and guest must wear proper swimming Thong bathing suits, cutoffs, etc. are not allowed.
  • Glass containers are absolutely prohibited in the pool
  • No food or drinks allowed in the pools. Smoking is not allowed in the
  • Pool furniture is to stay within the pool fence area and not moved to the beach or other areas of the



Reasonable Attorney’s Fees and Costs

In addition to the provisions set forth above with respect to attorney’s fees and costs, if guest’s breach or noncompliance causes Owner to employ an attorney or collection agent, guest shall be liable for all collection fees, reasonable attorney’s fees, and other costs incurred by Owner.



Rental Equipment/Furnishings

 
Under no circumstances shall furniture, bedding, mattress pads, utensils or any other property supplied within the rental property be taken outside the property or transferred from one property to another. Guests will be charged to retrieve or replace rental home property that is removed from the home. Moving of furniture is prohibited; do not move furniture or otherwise remodel the home. You will be charged for any repairs of any damages caused by moving items in accordance with the Accidental Damage Waiver Addendum.



Security of Personal Property

 
YBG is not responsible for any acts of theft or vandalism, other damages to any personal property, or for personal items left by guests in the accommodation at departure.



Signature and Identification Required

 

At the time of reservation, a Rental Agreement Contract will be sent via email. This contract will require digital signature within seven (7) days of the booking date. In additional to this signed contract, a photo copy of your government issued photo ID is required to secure booking. In the event the signed contract and photo ID copy are NOT received within seven (7) days, your reservation will be cancelled, and the deposit will be returned less a nominal processing fee.



Travel Protection Insurance

 
Travel insurance is available through CSA Travel Protection. In case of certain unforeseen events, this insurance may help to protect your vacation investment. The plan can be purchased on the CSA Travel Protection website at http://www.csatravelprotection.com. Details about the coverage and questions concerning CSA Travel Protection can be obtained by reviewing the certificate of insurance on their website at http://www.csainsuranceservices.com/pdf/G330CSA_doc.pdf or by calling CSA at 866-999-4018.



Unit Access/Service Policy

 
YBG will not enter property except to deal with an emergency; to make necessary or agreed repairs (either by owner or appointed repair persons); to supply necessary or agreed services; or to show the unit to potential purchasers. Unless there is an emergency, YBG will give guest at least 24 hours written notice of the date, time, and purpose of the intended entry and will schedule entries on Monday–Friday during normal business hours.


 

Use of Premises

 
Please observe all rules and regulations governing the use of the property and neighborhood you are occupying. These rules apply to both owners and guests, and failure to comply can result in eviction. All guests agree to comply with the HOA Rules and Regulations, which may be amended from time to time.



Walkways

 
Walkways on all floors are not for storing any items. Items left outside a condominium unit will be discarded. This includes items such as floats, buckets, tents, chairs, strollers, etc. HOA Maintenance can’t effectively keep the walkways clean if items are located there and they also become a safety hazard for our staff when cleaning.


 

Waiver of Jury Trial

 
By entering into this agreement, the parties knowingly and voluntarily waive the right to a Jury Trial as to any claims a party may have against the other which arises out of this agreement or the course of dealings between the parties.



ACCIDENTAL DAMAGE WAIVER ADDENDUM

 
All YBG reservations require guests to pay a non-refundable Damage Waiver fee. Guests of YBG who have paid the $59 non-refundable fee prior to checking in to a property will not be obligated to pay the first $1,000 in accidental damages, subject to the conditions and limitations set forth below. This accidental damage waiver is not insurance. It is a non-refundable, one-time charge per reservation that covers accidental damage reported by the guest prior to check-out for guests who have complied with the Agreement. In exchange for the payment of the Damage Waiver fee and the execution of this Agreement, which incorporates the terms of this limited waiver clause, YBG hereby waives the right to charge the guest for any reported damages to the Property that result from the guest’s accidental or inadvertent acts or omissions during the duration of their stay for damages up to, but not exceeding, $1,000.

Guests are responsible for any damages or losses in excess of the Damage Limit Amount of $1,000, as well as any damages or losses excluded from the terms herein.

 

Conditions and Limitations:

 
The Accidental Damage Waiver policy has certain conditions, limitations and exclusions. This Damage Waiver fee will not waive the guest’s liability for:

  1. Intentional acts or omissions, abuse or neglect by a guest, all invitees, or visitors of the guest.
  2. Negligence or gross negligence. This includes any damages to the property caused by acts or omissions that could have been foreseen by a reasonable person including damages resulting in any additional cleaning and/or maintenance costs.
  3. Any damage which the guest does not report to the YBG staff prior to checking out of property.
  4. Theft that results from guest’s failure to lock or secure the premises or property.
  5. Damages, additional cleaning costs or additional maintenance costs caused by unauthorized pet(s) in the property by guest or their invitees.
  6. Damages resulting from unauthorized smoking on or in a property by guest, all invitees, or visitors of the guest.
  7. Loss or Damage in excess of the Damage Limit Amount.
  8. Loss or Damage to any personal property of guest, all invitees, or visitors of the guest.

 

The policy applies only to the direct physical loss or damage to covered property. It does not cover loss of use of such property. This waiver is not intended in any way to provide reimbursement or coverage for the following items, which shall remain the responsibility of the owner of the property:

  1. Damages that constitute normal wear and tear.
  2. Damages resulting from acts of God, including but not limited to acts resulting in fire, flood or other natural disasters.
  3. Damages or losses to property which are unrelated to the actions of the guest.
  4. Theft that occurs despite the guest’s reasonable efforts to secure the property and related

items.

 

Procedures:

 
When a guest provides notice to YBG prior to check-out of accidental or inadvertent damage to the property, YBG will investigate the damage to determine whether the damage appears to have been caused by accidental or inadvertent actions and to determine the nature and extent of the damages and the necessity for and costs of the repairs or replacements. Such determination shall be made in the sole and absolute discretion of YBG provided there is some reasonable basis for making such a determination. YBG has ultimate claim administration authority.

We believe this information should only be used to help us provide you with better service. That’s why we have put a policy in place to protect your personal information. At Your Beachfront Getaway, LLC. we know that you have concerns about how your personal information is shared. We take your privacy concerns very seriously and are committed to ensuring that your personal information is secure at all times. We will only share your personally identifiable information in the following ways. The personal information you provide will only be shared with the appropriate third parties necessary to complete your purchases. This includes the vendors we have selected (e.g., third-party insurance companies,) as well as the third parties facilitating the transactions (e.g., credit card authorization companies). The personal information we provide these third parties will ONLY be that which is necessary to ensure your travel arrangements are successfully confirmed and executed.

We will protect the quality and integrity of your personally identifiable information. We have implemented appropriate technical and managerial procedures to maintain information that is accurate, current, and complete. We will make a sincere effort to respond to your requests to correct personal information inaccuracies in a timely manner.

We will take appropriate steps to protect your privacy. Whenever you provide sensitive information (for example, a credit card number to make a purchase), we will take reasonable steps to protect it, such as encrypting your card number. We will also take reasonable security measures to protect your personal information in storage. Credit card numbers are used only for payment processing and are not retained for marketing purposes.

Our website contains links to third party sites. Since we do not control those websites, we encourage you to review the privacy policies of these third-party sites.

We will also disclose personal information when required by law, in response to any demand by law enforcement or other appropriate government authorities, or if the personal information is pertinent in a legal proceeding or court action.

From time to time, we may need to change or update our privacy policy. If the policy has changes, this page will be updated. You will not be provided with any other notice of such changes. Please check this page to see if there have been any changes.
